TERMS AND CONDITIONS

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY ACCESSING OR PARTICIPATING IN THE CLUB 11-11 PROGRAM, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, DO NOT PARTICIPATE IN THE CLUB 11-11 PROGRAM.

GENERAL

  1. These Terms and Conditions apply to your access to, and participation in, the Club 11-11 program (“Club 11-11”) which is operated by Pizza Pizza Limited (“Pizza Pizza”). 
  2. There are no membership fees associated with Club 11-11. The loyalty dollars (“Loyalty Dollars”) accumulated under Club 11-11 are promotional and have no cash value.
  3. The Club 11-11 program is currently valid at all participating traditional Pizza Pizza locations, for walk-in, pick-up or delivery orders made in person, over the phone or through the Website or App. The Club 11-11 program is not valid at nontraditional Pizza Pizza locations. Examples of nontraditional Pizza Pizza locations include university or college food court locations, sporting venues, amusement parks, theatre locations and hospitals.

MEMBERSHIP 

  1. The Club 11-11 program is available to individuals for their personal use only and is limited to one account per individual. Corporations, associations, schools, government agencies or other groups may not participate in Club 11-11. 
  2. Individuals that are legal residents of Canada and at least the age of majority in their jurisdiction of residence are eligible to become Club 11-11 members.
  3. Your Loyalty Dollars, Club 11-11 Card, and your Club 11-11 account are personal to you and may not be sold, transferred or assigned to, or shared with, family, friends or others, or used by you for any commercial purpose. You may have only one Club 11-11 account that is personal to you.
  4. By joining Club 11-11, you agree that you have read, understood and agree to be bound by these Terms and Conditions and by any changes or modifications we may make. These Terms and Conditions do not alter in any way the terms or conditions of any other agreement you may have with us, including any agreement for products or services.
  5. To join the Club 11-11 program you must obtain a Club 11-11 Card from a participating traditional Pizza Pizza location or request a Club 11-11 Card number when you place an order online or through the App. Once you have obtained a Club 11-11 Card, you must register the card online at www.pizzapizza.ca in the Club 11-11 section or within your online ordering profile on the Website or App. You will be required to provide your full name, residential address, telephone number and email in order to register the Club 11-11 Card. You are solely responsible for maintaining the accuracy of your account information and for updating it as required. 

HOW CLUB 11-11 WORKS

  1. Under the Club 11-11 Program, you will earn Loyalty Dollars equal to 5% of every purchase made at a participating traditional Pizza Pizza location for walk-in, pick-up or delivery orders made in person, over the phone or through the Website or App with your Club 11-11 Card up to a maximum of $50 in Loyalty Dollars for any five purchase period.  Your Loyalty Dollars will be eligible for redemption on Pizza Pizza merchandise after every fifth purchase and must be redeemed within 90 days of being eligible for redemption.  For example, if you visit any participating traditional Pizza Pizza location 5 times and each order is $5.00 you will have earned $1.25 in Loyalty Dollars (5% (=$0.25) per order x 5 orders = $1.25), which you can redeem on your 6th purchase.
  2. You will earn Loyalty Dollars when placing an order on the Website, App or over the phone as well as on any walk-in order, as follows:
    • When placing an order by Website or App:
      • You can save your Club 11-11 Card on pizzapizza.ca (the “Website”) within your online ordering profile for quick and easy processing every time you order through the website or mobile website. Once you have added your Club 11-11 Card number to your online ordering account as described above and place your order through one of our Website or App, you will automatically earn Loyalty Dollars every time you order through the Website or App.
      • You can download the iPhone/iPad or Android App (the “App”) and save your Club 11-11 Card number on the Digital Wallet.  Once you have saved your Club 11-11 Card on the Digital Wallet, you can conveniently “Scan to Pay” with your mobile device at any of our traditional Pizza Pizza locations.
    • When placing an order by phone:
      • You can swipe your Club 11-11 Card at the time of purchase at the door or in-store.  Payment with a digital Club 11-11 Card at the time of delivery is not available at this time when ordering by phone.
    • When placing a walk-in order:
      • You can swipe or scan your Club 11-11 Card at the time of payment in-store. 
      • If you have added your Club 11-11 Card to your App, you can simply scan your mobile device by selecting to pay with Club 11-11. This must be done at the time of purchase, but prior to payment.
  3. Some exclusions apply. For example, you cannot earn Loyalty Dollars on purchases of gift card loads or reloads or purchases made using Loyalty Dollars. Taxes, tips, donations, deposits and delivery fees are also excluded and ineligible for Loyalty Dollar accrual. 
  4. You may redeem Loyalty Dollars in the following ways:
    • When placing an order through the Website or App with a physical Club 11-11 Card:
      • Prepay Online: Select “Pay Online” under the payment section, then select to pay with your Club 11-11 Card, either partially or in full with Loyalty Dollars.
      • At the time of delivery: Swipe your Club 11-11 Card at the door when the driver arrives.
      • In-store: Swipe your Club 11-11 Card at the cash or if you have added your Club 11-11 Card to your App you can simply scan your mobile device by selecting to pay with Club 11-11.
    • When placing an order through the Website or App with a digital Club 11-11 Card:
      • Prepay Online: Select “Pay Online” under the payment section, then select to pay with your Club 11-11 Card either partially or in full with Loyalty Dollars.
      • At the time of delivery: Payment with a digital Club 11-11 Card at the time of delivery is not available at this time.
      • In-store: Simply scan your mobile device by selecting to pay with Club 11-11.
    • When placing an order by phone:
      • Swipe or scan your Club 11-11 card at the time of payment (i.e. swipe is available at the door, swipe or scan is available in-store).
      • Payment with a digital Club 11-11 Card at the time of delivery is not available at this time when ordering by phone.
    • When placing a walk-in order:
      • Swipe your Club 11-11 Card at the time of purchase in-store.
      • If you have added your Club 11-11 Card number to your App, you can simply scan your mobile device by opening your digital wallet to pay with Club 11-11.
  5. If you use your Club 11-11 Card to pay for your sixth purchase, your Loyalty Dollars will automatically be deducted from the purchase price for such purchase.  If you wish to defer your Loyalty Dollars to a future purchase, you must pay with cash, credit card, debit card or meal card.  However, Loyalty Dollars earned over a five purchase period cannot be combined with Loyalty Dollars earned over a subsequent five purchase period.  As a result, at no time will you be eligible to redeem more than $50 of Loyalty Dollars in any one transaction.   It may take up to 24 hours for Loyalty Dollars to be loaded to your Club 11-11 account. 
  6. You may transfer any Loyalty Dollars that are eligible for redemption from one Club 11-11 Card to a replacement Club 11-11 Card.  However, you cannot transfer any partial progress (ie. visits one through five) towards eligible Loyalty Dollars. Where the balance of the Club 11-11 Card is fully transferred (ie. reaches a zero balance), it will be removed from the Account Details page, along with its history.

TERMINATION AND MODIFICATION

  1. Club 11-11 and its benefits are offered at Pizza Pizza’s sole discretion. Pizza Pizza may, without notice to you, terminate, discontinue or cancel the Club 11-11 program at any time and in its sole discretion.  The Club 11-11 Card is the property of Pizza Pizza Limited and must be returned upon request. 
  2. Without notice to you, Pizza Pizza reserves the right to suspend any Club 11-11 Card, terminate your account and/or your participation in Club 11-11 if Pizza Pizza determines in its sole discretion that you have violated these Terms and Conditions, you have more than one Club 11-11 account or that the use of your account is unauthorized, deceptive, fraudulent or otherwise unlawful. Pizza Pizza may, in its sole discretion, suspend, cancel or combine Club 11-11 accounts that appear to be duplicative. In the event that your participation in Club 11-11 is terminated, then all accumulated Loyalty Dollars in your Club 11-11 account will automatically expire.
  3. Without notice to you, Pizza Pizza reserves the right to terminate your Club 11-11 Card or Club 11-11 account if such card or account has been inactive for two consecutive years. Inactive is defined as neither earning nor redeeming any Loyalty Dollars. In the event that your Club 11-11 Card or Club 11-11 account is terminated for inactivity, then all accumulated Loyalty Dollars in your account will automatically expire. 
  4. To the maximum extent permitted by applicable law, Pizza Pizza reserves the right to change, modify and/or terminate Club 11-11 and/or all or any portion of these Terms and Conditions in accordance with this provision, including changes to the value of Loyalty Dollars. In the event these Terms and Conditions are changed or modified, Pizza Pizza will post the updated Terms and Conditions on its website. If the change or modification entails an increase in your obligations or a reduction in Pizza Pizza’s obligations, you may refuse the change or modification and rescind or cancel your participation in Club 11-11 without any cost or penalty by sending Pizza Pizza notice no later than thirty days after the change or modification comes into force. Your continued participation in Club 11-11 following any applicable notice period confirms your acceptance of these Terms and Conditions and any such changes or modifications.  Accordingly, you should review these Terms and Conditions frequently to understand the terms and conditions that apply to Club 11-11. If you do not agree to the Terms and Conditions, you must stop participating in Club 11-11.

GOVERNING LAW, LIMITATION OF LIABILITY AND DISPUTE RESOLUTION

  1. Use of the Club 11-11 Card is subject to all applicable laws and regulations. To the maximum extent permitted by applicable laws, these Terms and Conditions and their application and interpretation will be governed by the laws of the Province of Ontario without regard to conflict of law rules. 
  2. Pizza Pizza, its franchisees, affiliates, and their respective agents, representatives and employees (the “Pizza Pizza Group”) make no representations, warranties or conditions of any kind, express or implied, with respect to the Club 11-11 Card, including but not limited to, any express or implied warranty of merchantability, accessibility, acceptance, or fitness for a particular purpose to the maximum extent permitted by law. In the event a Club 11-11 Card is non-functional, Pizza Pizza shall only be liable for the replacement of the Club 11-11 Card. If any member of the Pizza Pizza Group is found liable to a card holder, the holder can only recover actual and direct damages not exceeding the last balance held on the Club 11-11 Card. To the maximum extent permitted by law, the Pizza Pizza Group is not liable for any incidental, indirect or consequential damages arising out of or in connection with the Club 11-11 Card or Club 11-11 account.
  3. Any dispute, claim, question or disagreement arising out of or in connection with Club 11-11, including ownership of your Club 11-11 account or Club 11-11 Card, shall be submitted to confidential arbitration and resolved in such form and pursuant to such rules as Pizza Pizza and you may agree upon or, in the absence of such agreement, by a single arbitrator appointed pursuant to the laws and rules relating to commercial arbitration in the province or territory in which you reside. The arbitrator’s award will be final and binding and may be entered as a judgment in any court of competent jurisdiction. To request arbitration of any dispute, claim, question or disagreement, you must present to Pizza Pizza a notice to arbitrate and written details of the claim. If Pizza Pizza wishes to arbitrate against you, it will deliver a notice to arbitrate and written details of the claim to your last known address or, if the last known address is not known to Pizza Pizza, the details and notice will be published in the daily newspaper of the city, town or municipality where you were last known to reside. 
  4. If a court of competent jurisdiction determines that any term, condition or provision of these Terms and Conditions is illegal, invalid or unenforceable, that term, condition or provision shall be severed from these Terms and Conditions and the remaining terms, conditions and provisions shall remain in full force and effect.

PRIVACY POLICY, WEBSITE AND CONTACT INFORMATION

  1. By registering for Club 11-11, you agree to be bound by our Privacy Policy, Gift Card Terms and Conditions and our website Terms and Conditions, which are incorporated herein by reference.  If you do not agree to these Terms and Conditions, our Privacy Policy, our Gift Card Terms and Conditions and our website Terms and Conditions, you cannot participate in Club 11-11.
  2. Please read the Privacy Policy available for review at www.pizzapizza.ca carefully to understand how Pizza Pizza collects, uses and discloses information about customers and how to update or change your personal information. 
  3. For information about Club 11-11 and your Club 11-11 account, contact the Club 11-11 Customer Service Centre at 1-866-368-2111 from within Canada or via email giftcard@pizzapizza.ca.  Pizza Pizza is not responsible for requests or correspondence lost or delayed in the mail or over the Internet.
